Scope
These terms govern the use of the LegalBytes website and client area, owned by Eduard Pinedo. Each engagement is governed in addition by the engagement letter you sign for it, which prevails in case of conflict.
Who we work for
Our services are aimed at companies, entrepreneurs and professionals acting in the course of their business. Engagements are agreed individually, in writing, for each company and matter.
No legal advice until you sign an engagement letter
The information on this website and the replies to contact enquiries are general guidance. A lawyer–client relationship, and advice on your particular case, only begins once you have signed an engagement letter. We never act on your behalf without it.
Who handles your matter
Every matter is handled by the founding lawyer, Eduard Pinedo, under the signed engagement letter. Any contentious step (appeals and, where applicable, court proceedings) is handled in-house by the same lawyer, only with your express approval and, for court proceedings, under a specific engagement letter and fee agreement.
Fees
Fees — per matter, per hour or, for fractional counsel, a monthly retainer — are agreed in writing in the engagement letter before any work starts. Official fees, registry fees, notary costs and similar charges are separate.
Obligation of means, not of result
Our obligation is to advise and act diligently. Decisions belong to authorities, registries and courts, and negotiations depend on the other party; no result is guaranteed.
Your obligations
- Provide truthful, complete and up-to-date information and documents.
- Tell us promptly about any change relevant to your matter.
- Keep your client area credentials confidential.
Consumers (exceptional)
If, exceptionally, you engage us as a consumer, your statutory consumer rights apply, including the right to withdraw from a contract concluded at a distance within 14 days; if you expressly ask us to begin work within that period, you will pay for the part already performed.
Use of the website and client area
You agree to use the website and client area lawfully and not to upload content that is unlawful or belongs to third parties without authorisation. We may suspend access in case of misuse.
Liability
Our liability is limited to the fees paid for the affected engagement, except in cases of wilful misconduct or gross negligence and where the law does not allow a limitation.
Law and jurisdiction
Spanish law applies. Jurisdiction is set in each engagement letter; consumers may in any case bring claims before the courts of their place of residence.
